In a 10-page verdict issued on Saturday, Chief Justice Qazi Faez Isa emphasized the importance of responsible journalism while appreciating those in the media who perform their duties professionally and truthfully. Chief Justice Isa was leading a three-member bench to decide on petitions seeking directions from the Supreme Court regarding the timing of general elections within 90 days.
During the case hearings, the court played a crucial role in facilitating a consensus between President Arif Alvi and the Election Commission of Pakistan (ECP) on the final date for general elections in the country. General elections are now slated to be held on February 8, resolving the uncertainty surrounding the matter. Chief Justice Isa’s role in achieving this consensus was particularly noteworthy compared to his predecessor, Umar Ata Bandial.
The Chief Justice had previously issued a warning to the media regarding speculation on the date of the general elections, urging restraint. In the written verdict, he acknowledged the vital role of the media in a democratic society while also cautioning against the misuse of press freedom.
Chief Justice Isa cited Article 19 of the Constitution, which guarantees “freedom of the press,” subject to reasonable restrictions. However, he expressed concern about certain elements in the media who interpret this freedom as a license to disseminate disinformation and construct false narratives, actions that ultimately undermine democracy.
He pointed out that such actions lead to decreased public confidence in democracy, discourage civic engagement, and suppress voter turnout, which are all detrimental to the democratic process. The Chief Justice underlined the responsibility of the media in upholding the democratic principles and values of the nation.
Chief Justice Isa also referred to the code of conduct of the Pakistan Electronic Media Regulatory Authority (PEMRA), which prohibits content that incites or condones the disruption of the democratic setup against the command of the Constitution. This regulation reinforces the need for responsible journalism and the media’s role in promoting democratic stability.
The written order also provided an overview of a vote of no-confidence against former Prime Minister Imran Khan last year, describing it as a “democratic move.” Chief Justice Isa endorsed the judgment of the bench headed by then-Chief Justice Umar Ata Bandial, which determined that President Arif Alvi’s actions to dissolve the parliament were illegal.
The verdict highlighted that President Arif Alvi had the power to announce a date for elections but used a power that did not vest in him when he dissolved the National Assembly. This key distinction in the legal framework was instrumental in clarifying the situation and ensuring that democracy was upheld.
In conclusion, Chief Justice Isa’s verdict reinforced the significance of responsible and ethical journalism as a cornerstone of a vibrant democracy. It underscored that the freedom of the press should be exercised with great responsibility to preserve the democratic values and principles of Pakistan.
